All homeowners must submit applications for approval for any additions, changes or removal of structure, landscaping, and exterior design. This is stated in Article III of the Architectural Control of the Declaration of Covenants, Conditions and Restrictions for Biscayne Pointe. Any variances to the original design will need to be approved in advance of work on the necessary form(s) for approval by the Architectural Review Committee.
Also part of Article III is: No residential structure, fence, wall, mailbox, detached storage or maintenance shed, driveway, boat dock, pier or other structure or improvement of any nature whatsoever shall be commenced, erected, placed or altered on or abutting any Lot or Common Area of the Subdivision until the design, location, plans, specifications and plot plans showing the location, nature, kind, shape, height, materials, color and other specifications have been approved in writing as to the quality of workmanship and materials, harmony of the exterior design with the requirement of this Declaration and with existing structures and location with respect to topography and finish grade by a majority vote of the Architectural Review Committee. For an existing home, in order to make changes or additions, the ADDITION/ALTERATION APPROVAL APPLICATION must be submitted to the ARC Committee for approval.
For a new home, the NEW HOUSE PLAN must be submitted to the ARC Committee for approval. This form must contain the approval signatures of all neighbors prior to submission and approval of the form.
The ARC committee meets on an “as-needed” basis. Once the committee receives an application(s), a meeting is set up to review the applications.
